Man charged with rape, sodomy

A Bowling Green teen told police she woke up early Thursday morning with a trusted family friend sexually assaulting her.

Anthony Martin, 59, of Bowling Green, is charged with first-degree rape and first-degree sodomy, according to his arrest citation.

When Bowling Green police arrived at the teen’s address on Bryant Way, the teenage girl was “very distraught and crying,” according to police records.

The teen told police she was awakened after having trouble breathing and Martin was on top of her, according to police records. She told police the contact was not consensual.

When she became fully awake she found Martin’s pants next to her and noticed that her own undergarments were off, as well as her blanket, according to police records.

She immediately texted her boyfriend, who got in touch with a neighbor to come get her. That neighbor retrieved clothing for the teen and then saw Martin lying naked in his bed, records show. 

Martin told police he had been drinking and that he has had multiple blackouts before, according to records. Martin also said that he and the teen had engaged in consensual sexual activity in the past and he assumed that since there was consensual activity in the past there also was consent for this sexual encounter, according to police records.

He told police he remembered going into the teen’s room and finding that the teen was “sorta asleep,” removing the teen’s panties and engaging in a deviate sex act, according to police records. He admitted that he “possibly” had sexual intercourse with the teen, according to his arrest citation.

“By further talking to Martin, he advised the victim never said anything or responded to him due to her being ‘possibly’ asleep,” according to Martin’s arrest citation. “It was determined the sexual intercourse was not consensual,” according to the arrest citation.

The teen was taken to The Medical Center for administration of a sexual assault kit.

Martin is lodged in Warren County Regional Jail in lieu of a $27,000 cash bond.

The Daily News does not identify alleged victims of sexual assaults.
