Negotiations ongoing in BG murder case, September trial date looms

The murder case against a Bowling Green man accused in a drive-by shooting may be resolved without a trial, his attorney said Monday during a hearing.
Torian Lamar Jackson, 38, appeared in Warren Circuit Court for a pretrial conference in a case in which he is charged with murder, first-degree wanton endangerment, first-degree criminal mischief, tampering with physical evidence and operating on a suspended or revoked operator’s license.
Jackson is accused of shooting Marcus McCathren, 40, of Bowling Green, in the early morning hours of Oct. 24, 2022, as McCathren was walking along Butler Way.
The criminal case is scheduled for a Sept. 17 jury trial, but Jackson’s attorney, Jason Pfeil of the Department of Public Advocacy, informed Warren Circuit Judge John Grise that he and Warren County Commonwealth’s Attorney Kori Beck Bumgarner have been discussing a resolution to the case.
“We are actively involved in plea negotiations at this point in time,” Pfeil said.
Grise asked Pfeil whether any testing of evidence was necessary or if there were other issues involving evidence, and Pfeil said he had been recently informed by Bumgarner about some more evidence her office planned to turn over in the case.
The trial remains on the calendar, and Grise set another pretrial conference for Aug. 26.
McCathren’s death was investigated by the Bowling Green Police Department, which responded on Oct. 24, 2022, to a report of shots fired on Butler Way and found McCathren, who was pronounced dead at the scene.
City police canvassed the neighborhood and reviewed video surveillance footage from nearby homes in an effort to find out more about the shooting.
BGPD Detective Jess Parry testified during a 2022 preliminary hearing that footage reviewed by detectives showed McCathren walking along Butler Way when he was shot by someone firing from the driver’s side of a black Nissan SUV traveling in the opposite direction.
Police received a number of tips in the week following the shooting, including one that came through South Central Kentucky Crime Stoppers in which Jackson was named as the shooter, Parry testified in 2022.
Detectives spoke with someone who claimed that Jackson admitted his involvement in the shooting to them the day after it occurred, according to court records.
Jackson was arrested Oct. 28, 2022, at an address on Cathy Way.
Parry said in the preliminary hearing that Jackson denied involvement in the shooting when he spoke with detectives, describing for police what he did and his whereabouts on the day of the shooting, though a witness shared knowledge with police that Jackson had been mad at McCathren after he had assaulted Jackson previously.
Jackson remains in Warren County Regional Jail under a $250,000 cash bond.
