Competency hearing sought in Logan murder case

RUSSELLVILLE – A judge has scheduled a hearing to determine whether a teenage suspect in a Logan County homicide is competent to stand trial.

De’Carlos Poindexter, 17, of Hopkinsville, appeared Thursday in Logan Circuit Court with his attorney, Mary Elizabeth Rohrer of the Department of Public Advocacy.

Poindexter is charged with complicity to commit murder, 11 counts of first-degree wanton endangerment and two counts of tampering with physical evidence in connection with the death of Joshua D. Burks, 20, of Clarksville, Tenn.

Burks was shot Aug. 13, 2022, being found in the 600 block of Kenny Stratton Road in Olmstead, where police say a field party was being held.

A juvenile at the time of the shooting, Poindexter is being prosecuted as an adult. He is one of three people charged in the incident.

In court Thursday, Logan Circuit Judge Joe Hendricks scheduled a competency hearing for Poindexter to take place Feb. 13.

Hendricks had previously ordered Poindexter to undergo a psychiatric evaluation after Poindexter’s defense team raised concerns about his ability to assist in his own defense and participate rationally in his case.

Poindexter’s brother, Jaquavion Poindexter, 22, of Hopkinsville, is charged with murder in connection with Burks’ death.

The shooting was investigated by Kentucky State Police.

According to an affidavit sworn by KSP Detective Graham Rutherford, the two Poindexter brothers and Laotis Buckley arrived at the party together.

Court filings indicate that an altercation occurred following a vehicle collision involving Burks and people who were friends of the Poindexters.

Interviews with witnesses and examination of evidence at the scene led police to conclude that Jaquavon Poindexter fired the shot that killed Burks, while Buckley allegedly discharged a firearm 11 times, striking Burks’ vehicle three times.

According to court records, KSP received information on Sept. 20, 2022, that shell casings recovered from the scene of the homicide could be connected through a ballistics examination of a firearm seized on Sept. 6, 2022, by police in Hopkinsville during a traffic stop involving De’Carlos Poindexter.

Buckley, 26, of Hopkinsville, pleaded guilty last year to a count of first-degree hindering prosecution/apprehension and was placed on pretrial diversion for five years.

Jaquavon Poindexter’s case is set for a jury trial on May 13.
