Court proceedings ongoing in BG drive-by shooting

Evidence gathered by police in a deadly 2022 drive-by shooting has been turned over to the defense, which is continuing its own investigations into criminal charges against the accused shooter.

Torian Jackson, 38, appeared Tuesday in Warren Circuit Court for a pretrial conference in a criminal case in which he is charged with murder, first-degree wanton endangerment, first-degree criminal mischief, tampering with physical evidence, first-degree persistent felony offender and operating on a suspended/revoked license.

The charges have been brought in connection with the death of Marcus McCathren, 40, of Bowling Green, who was found shot to death Oct. 24, 2022, on Butler Way.

Jackson’s attorney, Jason Pfeil of the Department of Public Advocacy, provided Warren Circuit Judge John Grise with an update on the progress of the case.

Pfeil said that discovery evidence has been turned over to him by the Warren County Commonwealth’s Attorney’s Office and he may be requesting additional items to help complete his investigation.

“Our investigation is still ongoing,” Pfeil said. “We’re proceeding about as quickly as we can but we’ll still need more time.”

Grise set another pretrial conference for Jan. 23.

Jackson remains in Warren County Regional Jail under a $250,000 cash bond, having been in custody since his arrest on Oct. 28, 2022.

The shooting was investigated by the Bowling Green Police Department.

According to prior court testimony, city police relied on video surveillance footage from nearby homes to determine that McCathren had been walking along Butler Way when he was shot by someone in a black Nissan SUV approaching from the opposite direction.

At a preliminary hearing held last year in Warren District Court, BGPD Detective Jess Parry testified that three shots were fired from the driver’s side vehicle, with one striking McCathren.

Police later received multiple tips, including one through South Central Kentucky Crime Stoppers in which Jackson was named as the shooter.

BGPD detectives located a witness who reported that Jackson told her the day after the incident that he had killed McCathren, and police were informed of an earlier incident in which McCathren reportedly assaulted Jackson, according to prior testimony from Parry.

Jackson denied involvement in the shooting when questioned by detectives.
