Teen charged in Logan shooting pleads guilty

RUSSELLVILLE — A teenager who was one of three people charged in connection with a deadly 2022 shooting in Logan County has pleaded guilty.

De’Carlos Poindexter, 18, of Hopkinsville, pleaded guilty Thursday in Logan Circuit Court to 11 counts of first-degree wanton endangerment and two counts of tampering with physical evidence.

Poindexter was arrested as part of a Kentucky State Police investigation into the death of Joshua Burks, 20, of Clarksville, Tennessee, who was shot and killed Aug. 13, 2022, at a field party off Kenny Stratton Road in Olmstead.

According to court filings and prior court testimony, Poindexter’s brother, Jaquavon Poindexter, was identified as the person who fired the shot that killed Burks.

Jaquavon Poindexter pleaded guilty to first-degree manslaughter, accepting a 15-year sentence.

The Poindexters and Laotis Buckley were part of a group that got into a confrontation with Burks after their two vehicles were involved in a collision at the field party.

Logan County Assistant Commonwealth’s Attorney Nathan Beard said the evidence at trial would have been that Burks had a gun in his waistband during the confrontation, but did not take it out at any point.

Beard said an AR-15 was used in the deadly shooting and that De’Carlos Poindexter or Buckley fired several shots from a separate handgun, with some rounds striking Burks’ vehicle.

Buckley pleaded guilty to first-degree hindering apprehension or prosecution and was placed on pretrial diversion.

There also would have been evidence presented at trial that De’Carlos Poindexter attempted to sell the AR-15 after the homicide, Beard said.

De’Carlos Poindexter accepted a plea agreement that dismissed an additional count of complicity to commit murder and that recommended a 20-year sentence on the remaining charges.

Though he was a juvenile at the time of the incident, De’Carols Poindexter was prosecuted as an adult.

He will return to court April 17 to be sentenced by Logan Circuit Judge Joe Hendricks.
