A week before a scheduled trial, a Bowling Green man accused of hiding a gun allegedly used by his brother in a drive-by shooting pleaded guilty.

Jayro Pineda, 41, entered a guilty plea Friday in Warren Circuit Court to a count of tampering with physical evidence.

Pineda was one of three people facing criminal charges in connection with the death of Gregorio Alberto Jimenez, who was found shot to death on June 3, 2021, in the 700 block of Glen Lily Road.

Eder Martinez-Pineda has pleaded not guilty to charges of murder and tampering with physical evidence, while Brittany Miller is under indictment on a charge of first-degree hindering prosecution or apprehension.

Jayro Pineda’s attorney, Neal Tucker, provided the factual basis for Pineda’s guilt on the tampering charge when asked Friday by Warren Circuit Judge J.B. Hines.

Tucker said that Bowling Green Police Department detectives investigating Jimenez’ death arranged for Martinez-Pineda’s ex-wife to call him and ask him about the shooting.

During the conversation, Martinez-Pineda reportedly admitted to his involvement in the shooting and giving the gun to his brother afterward.

“Jayro disappeared it is the way (Martinez-Pineda) put it,” Tucker said in court.

Pineda accepted a plea agreement placing him on pretrial diversion for three years, with the charge against him to be dismissed in that time if he abides by all the conditions of the agreement.

Pineda will be required to give truthful testimony at any trial involving his co-defendants, and he will be subject to random drug tests by the Department of Probation and Parole.

As a person living in the U.S. without legal permission, Pineda would also be subject to deportation proceedings.

If he is found to have violated any conditions of his pretrial diversion, Pineda could face three years in prison.

According to prior court testimony, witnesses on Glen Lily Drive reported hearing gunfire from inside their homes, with one witness reporting having seen a Chevrolet Suburban speed away from the source of the gunshots soon afterward.

A BGPD officer had responded to a call at a Collegeview Drive address the night before the shooting to investigate a report that Jimenez wanted to fight someone there.

Officers investigating the shooting went to the address and found a black 2015 Chevrolet Suburban parked in the driveway and learned it was registered to Jayro Pineda, according to prior testimony.
