The driver of a horse and buggy involved in a crash Tuesday is accused of being drunk at the reins and faces 10 felony counts.

Reuben Yoder, 34, of Smiths Grove, was arrested Tuesday on nine counts of first-degree wanton endangerment and a count each of first-degree criminal mischief and operating a nonmotor vehicle while under the influence of intoxicants.

Yoder was arrested by the Smiths Grove Police Department, which responded about 10:30 p.m. to a reported crash at Hydro Pondsville Road and T. Elkins Road.

Yoder, who was driving with his wife and their seven children in the buggy, had been involved in a sideswipe crash with a car at the intersection.

The driver of the car was not injured and told police she didn’t see the horse and buggy until just before the crash and attempted to avoid the collision.

Smiths Grove Assistant Chief Wes Jenkins said in an arrest citation that he detected an odor of alcoholic beverage from Yoder, who had slurred speech and bloodshot eyes.

“(Yoder) exhibited poor balance and stated he had consumed alcoholic beverages,” Jenkins said in the arrest citation.

Field sobriety tests and a breath test suggested the presence of alcohol, and Yoder was arrested and taken to The Medical Center for evaluation.

The car involved in the crash had damage to its front bumper and on the driver’s side.

The horse and buggy had two yellow reflector lights on its front, according to the arrest citation.

“(Yoder) initially claimed one of his children was operating the buggy,” Jenkins wrote in the citation, adding that the children identified Yoder as the driver.

The children ranged in age from 9 months to 12 years old.

The wanton endangerment and criminal mischief counts are all Class D felonies, punishable by up to five years in prison.

Yoder was arraigned Wednesday by Warren District Judge Sam Potter, who set a $2,500 surety bond.
