With key witness absent, Nash’s DUI trial postponed again

Bowling Green City Commissioner Brian “Slim” Nash will finally get his day in court almost four years to the day after his arrest on a charge of operating a motor vehicle while under the influence and improper turning.
With arresting officer Larry Zuniga of the Bowling Green Police Department unable to attend Tuesday’s scheduled trial before Special Judge Derek Reed at the Warren County Justice Center, Reed rescheduled the trial for Oct. 24 at 9 a.m.
Zuniga, described as an “indispensable witness” by special prosecutor Don Jones, had to leave last Thursday to be with his mother in south Florida as Hurricane Irma was bearing down on that area.
Alan Simpson, attorney for Nash, asked that the charges against his client be dismissed but Reed refused.
“This case has been out there a long time, and I’m determined to try it,” said Reed, who serves as the 10th District judge in Hart and LaRue counties but was appointed to this case after Warren County District Judge Brent Potter recused himself.
The case dates back to Oct. 27, 2013, when Nash was arrested by Zuniga after Nash made a left turn from Broadway onto the U.S. 31-W Bypass and then a right turn into Taco Bell.
