Walker murder trial is moved

A scheduling conflict involving two potential witnesses led to the postponement of a murder trial that had been scheduled for this month in Warren County.

Joseph Paul Walker is now expected to stand trial in Warren Circuit Court in November on charges of murder, first-degree assault and first-degree wanton endangerment.

Walker, 32, of Bowling Green, appeared in court Wednesday for a motion hour in his case.

Walker’s court-appointed attorney, Kristy Vick-Stratton, moved to have the trial delayed from its scheduled June 14 starting date because two law enforcement officers she had considered calling as witnesses are scheduled to take part in military training later this month and would be unavailable to testify.

Warren Circuit Judge John Grise granted the motion, rescheduling the trial for Nov. 15.

Walker is accused of fatally shooting Demarcus Elliott, 34, on Oct. 9, 2012, as Elliott sat in Elliott’s car in a driveway on Victoria Street.

Elliott’s passenger, Veronica Mitchell, was wounded in the shooting but survived.

Prior court hearings in the case have included the disclosure that Walker had traveled to and used drugs at Elliott’s residence on the night of the shooting, and that he and Elliott were involved in a confrontation with each other before the homicide.

Special Prosecutor Blake Chambers is handling the case, having been appointed after Walker’s former attorney, Daniel “Tres” Miller, joined the Warren County Commonwealth’s Attorney’s Office as an assistant prosecutor.

Walker is currently incarcerated as a state inmate, serving an 18-year sentence for first-degree trafficking in a controlled substance (second or greater offense), second-degree trafficking in a controlled substance and fraudulent use of a credit/debit card (greater than $500).
