A Bowling Green man convicted in a 2012 ax attack will remain in prison after a judge denied his motion for shock probation.

Joshua Travis, 31, is serving a 10-year sentence for second-degree assault and two counts of first-degree wanton endangerment. He pleaded guilty to the charges last year, which arose from an incident at Garden Apartments in which he struck a man in the torso with an ax, then swung the ax into several apartment doors at the complex.

Travis had filed a motion for shock probation, a type of probation that grants early release to prisoners convicted of certain offenses after serving 30 to 180 days of their sentence.

An inmate at Green River Correctional Complex, Travis was not transported to Warren Circuit Court on Thursday to argue his case.

Warren Circuit Judge Steve Wilson found that Travis’ motion was not filed in a timely fashion because he has already served 180 days in prison.

Wilson added that he would have overruled Travis’ motion due to the nature of the offenses he committed. A prior motion for shock probation in the case had also been overruled.

Travis was charged in the Oct. 16, 2012, incident at the Trent Way apartment complex, in which he crashed his van into another vehicle in the parking lot of the complex that night.

According to court records, Sakib Husejnovic was in an outdoor common area at the time and approached Travis, who retrieved the ax from the van and swung it at Husejnovic, who was treated at a hospital for his injury.

Several people at the complex called police during the incident, and the Bowling Green Police Department found that a group of bystanders confronted Travis, struck him and knocked him to the ground.

Travis was found unconscious by Bowling Green police when they arrived, and he was treated overnight at Vanderbilt University Medical Center in Nashville before being arrested.
