Trials delayed in boy’s death

SCOTTSVILLE — Trial dates for two people accused in connection with the 2011 death of an 18-month-old boy have been pushed back four months to ensure that expert witnesses are able to testify.
Allen Circuit Judge Janet Crocker rescheduled the trials for Timothy Steen and Julie Green, both of Scottsville, for July 31.
Steen, 27, is charged with second-degree manslaughter and Green is charged with second-degree criminal abuse in the death of Peyton Green.
Peyton died July 2, 2011, at Monroe Carell Jr. Children’s Hospital at Vanderbilt in Nashville a day after the Kentucky State Police began an investigation regarding an unresponsive toddler.
Green, 23, is identified in court records as Peyton’s mother.
Both cases had been set for a jury trial March 20, but Crocker rescheduled them Tuesday during a pretrial conference.
Allen County Commonwealth’s Attorney Clint Willis said medical experts he plans to have testify in the case will be available between July 31 and Aug. 2, which is how long the trials are anticipated to last.
Steen is being held without bond in Allen County Detention Center, where a spokeswoman said he is currently serving a sentence on an unrelated case.
Court records show that Steen has previous felony convictions in Allen County for drug possession in 2005 and 2010.
Green is free on a $10,000 unsecured bond.
Steen and Green were indicted June 29 by an Allen County grand jury, nearly a year after Peyton’s death.
In a letter filed July 7 and addressed to Crocker, Green denied any wrongdoing and requested that a second autopsy be performed to determine Payton’s cause of death.
Steen is scheduled to return to court Tuesday for a pretrial conference in a separate case in which he is charged with first-degree fleeing or evading police, operating on a suspended/revoked license, speeding, reckless driving and leaving the scene of an accident. That case is scheduled to go to trial March 21.
