Grand jury indicts funeral director on more theft counts

A Warren County grand jury returned a five-count indictment Wednesday against Jamie Lynn Stoner, 38, a Bowling Green funeral home operator.

Stoner, whose address is listed on the indictment as 3400 Cemetery Road, is accused of five counts of theft by failure to make required disposition of property valued at $500 or more but less than $10,000, according to Warren Circuit Court records. The charges are in addition to a grand jury indictment against Stoner last month on theft by failure to make required disposition valued at $500 or more but less than $10,000 and aid without license/impersonating funeral director.

Stoner operated Stoner Family Funeral Home on Campbell Lane until recently, when he moved his business to Cemetery Road and changed the name to Hillside Chapel.

“Until I have an opportunity of looking at the indictment and talking to Mr. Stoner, I’m really not in a position to make a comment about the charges of the second indictment,” Stoner’s attorney, Michael Bratcher, said about the latest criminal allegations against Stoner.

Stoner turned himself in to deputies at the Warren County Sheriff’s Office late Tuesday morning for the September charges. He was booked at the Warren County Regional Jail, where he posted a $5,000 surety bond, according to jail records.

Bratcher has filed a motion for a speedy trial in Warren Circuit Court for the charges in the September indictment. A hearing on that motion is scheduled for Monday.

Bratcher was not surprised by the latest indictment.

“From information given to me from the Commonwealth’s Attorney’s office, this is not a surprise, and we knew that there were some dissatisfied customers out there and some outstanding business problems,” Bratcher said.

While the criminal cases are pending in Warren County, Stoner has filed a civil petition for a declaration of rights and administrative appeal from the Kentucky Board of Embalmers and Funeral Directors in Franklin Circuit Court.

Stoner’s funeral director’s license expired July 31. The board decided not to renew Stoner’s funeral director’s license or his embalmer’s license and did not issue Stoner an establishment license for Hillside Chapel.

After Bratcher wrote an objection letter to the Kentucky Board of Embalmers and Funeral Directors, an administrative hearing on the issue was scheduled for Oct. 26 and 27 in Louisville. That hearing will probably be rescheduled due to Fifth Amendment concerns, Bratcher said, noting that anything Stoner says during that hearing could potentially be used against him in the criminal charges in Warren County, he said.

In the petition filed in Franklin Circuit Court, Stoner is asking the court to order the Kentucky Board of Embalmers and Funeral Directors to reinstate his license and retroactively issue an establishment license for his funeral home.

“It’s no secret in the legal community that Mr. Stoner has had financial and personal stresses during the last year,” Bratcher said. “If there are any other dissatisfied customers, they should feel free to call my office, and we will be glad to work through the problems.”

Warren County Commonwealth’s Attorney Chris Cohron couldn’t comment on the specifics of the newest allegations against Stoner, but did say that he expects future grand jury presentations.
