Federal lawsuit claims arrest beating

A Franklin man has filed a $10.5 million civil suit contending he was arrested and beaten by several Franklin police officers. The suit, filed Friday in U.S. District Court in Bowling Green, alleges that police beat Steve Kelley during a traffic stop shortly after midnight Nov. 21.The suit alleges Kelley was followed and stopped by Franklin police Officers Jason Paine and Eddie Lawson, who suspected he was driving under the influence. Immediately after Kelley was stopped, Officers Kevin Halvorsen, Steve Smith, Jim Mincy and Johnny Patterson arrived on the scene, the suit said. Without provocation or warning, the defendants held and/or hit (Kelley) about his back, buttocks, arm and face with their fists and weaponry, the suit said. Kelley was unarmed and posed no physical threat, the suit said. Kelley suffered facial and body abrasions, contusions and a broken tooth, requiring extensive medical treatment, the suit said. Police charged Kelley with DUI, resisting arrest and terrorist threatening; he is awaiting a February trial in the case, according to Simpson District Court records. Kelley is suing all of the officers involved, police Chief Jamie Powell and the city of Franklin. The suit contends that Powell and the city authorized, permitted and tolerated the custom and practice of the unconstitutional and excessive use of force by members of the Franklin City Police Department. The suit contends that the defendants behavior was extreme and outrageous and caused Kelley to suffer severe and permanent mental distress. He is seeking a jury trial, $7 million in compensatory damages for past and future medical and psychiatric expenses, $3.5 million in punitive damages and any other costs or relief to which he may be entitled. Claims made in the filing of a lawsuit reflect only one side of the case.
